These Terms of Use ("Terms") govern your access to and use of profsharemarketresearch.com and any services offered through it. By using the site or making a purchase, you agree to these Terms.

The use of any specific Report you purchase is additionally governed by our Licence Agreement.

1. About Us

Profshare Market Research publishes syndicated market research reports for business use. Reports are sold under one of three licence tiers (Cloud Access, Team Licence, Enterprise), each with its own scope of permitted use as set out in the Licence Agreement.

2. Eligibility

To make a purchase, you must:

• Be at least 18 years old, or the age of majority in your jurisdiction;
• Have legal authority to bind the organisation you represent (where purchasing on behalf of an organisation);
• Provide accurate, current, and complete information at purchase, including a valid work email address (we do not accept free email providers such as gmail, yahoo, or outlook for licence registration);
• Not be located in any jurisdiction where our services are restricted or prohibited.

3. Account Registration

When you complete a purchase, an account is created using the email address you provide. You are responsible for:

• Keeping your account credentials confidential;
• All activity that occurs under your account;
• Notifying us promptly at [email protected] of any unauthorised access.

Account email addresses cannot be changed after creation. For Team and Enterprise tiers, additional users are managed by the licence administrator from within their account.

4. Pricing and Payment

4.1 Pricing

All prices are listed in US Dollars (USD) and are exclusive of applicable taxes, duties, or bank charges, which are the buyer's responsibility unless explicitly stated.

Prices may change at any time. The price in effect at the time of purchase applies to that order.

4.2 Payment Methods

We accept payment via:

• Card / Razorpay (cards, UPI, netbanking- domestic and international)
• PayPal
• Bank transfer / invoice (typically used for procurement and Enterprise purchases)

For bank transfer orders, an invoice with payment instructions is emailed within one business day. The Report is delivered after payment is received and confirmed.

4.3 Order Confirmation

Your order is confirmed once payment is successfully processed. You will receive an order confirmation by email at the address provided.

5. Delivery

Reports are delivered electronically to your account on profsharemarketresearch.com, typically within 48 hours of payment confirmation. You will receive an email notification when the Report is ready.

We are not responsible for delays caused by incorrect or undeliverable email addresses, spam filters, payment gateway delays, or external factors beyond our reasonable control.

6. Cancellation and Refund Policy

Reports are digital goods. The following policy applies:

6.1 Before delivery

You may cancel your order at any time before the Report has been delivered to your account. Cancellations made before delivery are eligible for a refund of the amount paid, less a 25% cancellation charge to cover payment processing, account setup, and analyst preparation costs already incurred.

To cancel, email [email protected] with your order reference before delivery. Cancellations are processed within 7 business days. Refunds are returned to the original payment method.

6.2 After delivery

Once the Report has been delivered to your account, all sales are final and no refunds will be issued. This applies to all licence tiers and all payment methods, including bank transfer.

By completing a purchase, you acknowledge and agree to this refund policy.

6.3 Chargebacks

If you have a concern with your order, please contact us first at [email protected] so we can resolve it directly. Initiating a payment dispute or chargeback after delivery, without first contacting us, may result in immediate termination of your licence and access, in addition to any remedies available under the Licence Agreement.

7. Acceptable Use of the Website

You agree not to:

• Use the website in any unlawful manner or for any unlawful purpose;
• Attempt to gain unauthorised access to any part of the website, accounts, or systems;
• Use automated means (scrapers, bots, crawlers) to access Reports or website content beyond what is permitted by our robots.txt;
• Upload viruses, malware, or any other malicious code;
• Interfere with or disrupt the website's operation or its security features;
• Impersonate another person, organisation, or misrepresent your affiliation;
• Use the website to develop or train any AI/machine-learning model on our content.

We may suspend or terminate access for any breach of this Section.

8. Privacy and Data

Information you provide at purchase (name, email, company, billing address, phone, and payment information) is used to:

• Process your order and deliver the Report;
• Manage your account and provide customer support;
• Send transactional emails (order confirmations, set-password links, delivery notifications);
• Comply with legal, tax, and accounting obligations.

We do not sell your personal information. Payment card data is processed directly by our payment gateways (Razorpay, PayPal) and is not stored on our servers.

9. Intellectual Property - Website

10. Third-Party Services

The website integrates with third-party payment processors (Razorpay, PayPal) and may include links to third-party websites. We are not responsible for the content, policies, or practices of those third parties. Your use of those services is subject to their own terms and policies.

11. Disclaimer

The website and the Reports are provided "as is" and "as available", without warranties of any kind, express or implied. Reports represent research-based analysis and reasonable estimates as of their publication date; they do not constitute investment, legal, tax, financial, or professional advice.

You are solely responsible for any decisions made on the basis of Reports or any other content on the website. We make no warranty that the website will be uninterrupted, error-free, or free of viruses.

12. Limitation of Liability

To the maximum extent permitted by law, Profshare's total liability arising out of or relating to these Terms, for any cause whatsoever shall not exceed the amount you paid for the specific Report or service giving rise to the claim. Profshare shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits, lost data, or business interruption, however caused.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages; in those jurisdictions, our liability is limited to the greatest extent permitted by law.

13. Indemnification

You agree to indemnify and hold Profshare, its directors, employees, and affiliates harmless from any claim, damage, loss, liability, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of any Report, or your violation of any law or third-party right.

14. Termination

We may suspend or terminate your access to the website and/or your account at any time, with or without notice, if you breach these Terms or the Licence Agreement, or if required by law.

You may terminate your account at any time by contacting [email protected]. Termination does not entitle you to a refund of any fees already paid (see Section 6).

15. Changes to these Terms

We may update these Terms from time to time. The version in effect at the time of your purchase governs that purchase. We will post the current version on this page with the effective date above. Continued use of the website after an update constitutes acceptance of the updated Terms.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of state of Maharashtra (India). The courts of Pune (India) shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.

18. Entire Agreement

These Terms, together with the Licence Agreement, constitute the entire agreement between you and Profshare regarding your use of the website and any Reports purchased.
